Terms of Service

1. GENERAL PROVISIONS

1.1. These Terms of Service (the "Terms") constitute a legally binding agreement between Maciej Iwanicki, with its registered office in Poland (the "Operator," "we," "us," or "our"), and the user ("User," "you") regarding your use of the Kordvi website and platform available at https://app.kordvi.com (the "Service").

1.2. By accessing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue your use of the Service immediately.

1.3. The Service is intended for natural persons acting as consumers or professionals.

2. DEFINITIONS

• Service - The Kordvi platform designed for managing gaming events, communities, and player progression.
• Account - A dedicated profile established by the User to access the Service's features.
• Community - A group of Users organized within the Service sharing common gaming interests.
• Event - A gaming tournament or gathering organized via the Service.
• Content - Any text, graphics, images, software, audio, video, information, or other materials available on the Service.

3. REGISTRATION AND ACCOUNT SECURITY

3.1. To access certain features, you must register for an Account. You agree to provide accurate, current, and complete information (specifically your email address and username) during the registration process.

3.2. You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your Account, whether or not you have authorized such activities.

3.3. Each Account is personal and non-transferable. Creating multiple accounts for the purpose of abusing Service functionality or creating Accounts by automated means (bots) is strictly prohibited.

4. SCOPE OF SERVICES

4.1. The Service provides tools for creating gaming communities, organizing events, tracking progression (XP, levels, rankings), and awarding achievements.

4.2. The Service is offered in a free tier ("Free") and a paid tier ("Premium"). Specific features of each tier are described on the Service's pricing page.

4.3. The Operator reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, specifically to improve technical functions or user experience.

5. PAYMENTS AND SUBSCRIPTIONS

5.1. Premium Plan: Access to Premium features requires payment of fees as described in the Service. All fees are inclusive of applicable taxes unless stated otherwise.

5.2. Processing: Payments are processed securely by a third-party payment processor. The Operator does not store your full credit card information.

5.3. Cancellation: You may cancel your Premium subscription at any time via your Account settings. Cancellation will take effect at the end of the current billing period.

5.4. Refunds: Refunds are handled in accordance with applicable consumer protection laws. Consumers in the EU have a right of withdrawal within 14 days of purchase, unless the digital content provision has begun with the consumer's express consent and acknowledgment that they thereby lose their right of withdrawal.

6. INTELLECTUAL PROPERTY RIGHTS

6.1. Operator IP: The Service, including its original content, features, code, and functionality, are and will remain the exclusive property of the Operator and its licensors.

6.2. License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business purposes.

6.3. Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

7. USER CONTENT

7.1. You retain ownership of any intellectual property rights that you hold in the content you submit or publish on the Service.

7.2. By submitting content, you grant the Operator a worldwide, royalty-free license to use, host, store, reproduce, modify, create derivative works, communicate, and distribute such content solely for the purpose of operating, promoting, and improving the Service.

7.3. You represent and warrant that you have all rights necessary to grant us the license mentioned above and that your content does not violate any third-party rights or applicable laws.

8. PROHIBITED ACTIVITIES

8.1. You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Infringing the rights of others, including privacy and intellectual property rights
• Posting content that is offensive, vulgar, defamatory, or promotes hate speech
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
• Using the Service for spamming, phishing, or other unsolicited advertising

9. LIMITATION OF LIABILITY

9.1. To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9.2. The Operator does not guarantee that the Service will function without interruption or errors.

9.3. For paid services, the Operator's total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us to use the Service in the 12 months preceding the claim.

10. TERMINATION

10.1. You may terminate your Account at any time through the Service settings.

10.2. We may terminate or suspend your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10.3. Upon termination, your right to use the Service will immediately cease. Provisions of the Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. CHANGES TO TERMS

11.1. We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice before any new terms take effect.

11.2. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1. These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

12.2. Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts having jurisdiction over the Operator's registered office.

12.3. ODR Platform: Consumers in the EU may also use the Online Dispute Resolution platform available at http://ec.europa.eu/consumers/odr.
